In the following terms & conditions “the photographer” shall mean Stephen Cain trading as Stephen Cain Photography. “The client(s)” shall be those persons defined in the booking form. It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing. By booking with the photographer you agree to the below Terms and Conditions.
PAYMENT TERMS
For studio work we require a £20.00 booking fee which is non refundable and will secure your booking. This booking fee will be subtracted from your final session fee. Full payment is required on completion of your photoshoot. We accept PayPal, BACS Transfer and most major Credit Cards
For any pre paid event we require a payment of 50% to be paid at least 4 weeks before the event date. The outstanding balance of 50% should be paid within 7 days on completion of event.
PRINTS REPRINTS & ENLARGEMENTS
We offer a vast array of print and enlargements sizes all with different aspect ratio’s, all of my images are shoot to the aspect ratio of 2:3 which is ideal for most popular enlargement options. However on some of the enlargements sizes I offer image cropping may/will occur. Please ask advice before ordering enlargements
OUR REQUIREMENTS ON THE NIGHT - EVENTS
For the lighting studio, background and print & viewing station we require an area approx 4m x 4m preferably against a flat wall which is not blocking any fire escapes, other exits or entry points and stairs. It is important that we can be seen by guests and our preference is to be in the main event room. We will require 2 strong tables 1m x 1m approx, two chairs and a minimum of two 13 amp power sockets.
POST EVENT SALES
All images will be up loaded onto our web site within 7 to 14 days of event date. Pin protected galleries can be used if required and requested by client.
OTHER PHOTOGRAPHERS
We do not tolerate people taking smart phone images on the night from our display screens to use on other web sites and social networking sites. We are happy to sell digital downloads on the night at £5.00each for this purpose.
COPYRIGHT
The Author retains the entire copyright in the Photographs and Works at all times, throughout the World and were a reproduction of Works has taken place and settlement has not been made, the Photographer will make such charges to the publisher of those images as falls within the Copyright, Designs and Patents Act 1988.
Any images or copies of images, whether stored digitally or otherwise and any computer Including any source or object code, computer file or printed documentation relating to such are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be Photographically / electronically or by any other means an image created as part of this agreement without the written permission of stephencainphotography.
CLIENT CONFIDENTIALITY.
The Photographer will keep confidential and will not disclose to any third parties or make use of information communicated to him/her in confidence for the purposes of the photography, save as may be reasonably necessary to enable the Photographer to carry out his/her obligations in relation to the commission.
DISPLAY AND MARKETING
The Client hereby gives permission for stephencainphotography to display any images in this contact in studios, portfolios, literature, exhibitions, advertising, competitions, magazines on websites. No use of any of the images will be used for other commercial reasons, except written permission from the Client
FORCE MAJEURE ACT OF GOD
The due performance of this agreement is subject to alteration or cancellation by either party owing to any cause beyond their control.
LIMITATION OF LIABILITY
In the event of an Act of God,illness injury the unlikely event of total photographic failure or the cancellation of this contact for any other reason, the liability of one part to the other shall be limited to the total value of the contracted package. Neither party shall be liable for indirect or inconsequential loss. We will always do our best to try to re arrange your appointment or to try and book another photographer if possible.
THE PHOTOGRAPHER
On occasions and without notice it may be necessary to substitute the original photographer(s) for others. This will only happen in instances of illness or other emergencies or unforseen circumstances
PROFESSIONAL STANDARDS
We will do our best to make sure you have a great evening and get the images you want. We are Affiliate members of the EPS ( Event Photographic Society ) and SISEP ( The International School & Event Photographers ) and abide by their regulations and code of conduct. We will work to your brief providing this is given at least 4 weeks before the event in writing through our web page or email. We will comply with any necessary health & safety instructions and always appreciate the venues help and advice on this matter.
ARCHIVE
The Photographer will maintain backup copies of the images in their archive for a period of 3 years at which time the client may buy all original files on CD or DVD.
APPLICABLE LAW.
This agreement shall be governed by the Laws of England & Wales.
POST PRODUCTION AND EDITING:
The final post production and editing styles, effects, and overall look of the images are left to the discretion of the photographer.
PERSONAL ACCIDENT
Any directions issued to clients, their guests or employees during a photographic shoot/event are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot
COMPLAINTS PROCEDURE
Please address any complaints to Stephen Cain Photography by email or writing as per my contact details. I will endeavour to respond to any complaint within 5 working days of receipt.
